EXPLOITATION OF THE ELDERLY

The term "exploitation" as defined under NRS 200.5092(2) refers to the wrongful use of an older person's money or property to benefit another person. Originally established in 1983 under Nev.Stat., ch. 505, § 1, at 1359, exploitation specifically pertains to actions concerning the property or assets of elderly individuals.

Currently, exploitation is prohibited by separate provisions outlined in NRS 200.509912, which defines it as any action by a person who has gained the trust and confidence of an older person, or the misuse of power of attorney or guardianship, to gain control over the older person's money, assets, or property through deception, intimidation, or undue influence. The intent of such actions is to permanently deprive the older person of ownership, use, benefit, or possession of their money, assets, or property.

It's important to note that "undue influence" in this context excludes normal familial influence. The Nevada Legislature designed the concept of exploitation to protect older individuals' assets and property, regardless of whether physical harm or suffering is involved.

TYPES OF FINANCIAL EXPLOITATIONS

In Nevada, financial exploitation of the elderly occurs when someone unlawfully misuses or appropriates the assets of a person aged 60 or older, or a vulnerable adult, for their own personal gain. This exploitation often occurs without the victim's awareness or consent, resulting in the deprivation of crucial financial resources that the victim requires for their personal necessities.

Assets or financial resources can be taken by:

  • Fraud: This involves dishonest acts by individuals entrusted to manage assets, where they misappropriate assets for purposes not intended by the victim. Examples include Ponzi schemes, unauthorized check-writing, falsification of records, and forgeries. It can also involve inappropriate insurance sales, such as selling a long-term annuity to an elderly person, or unauthorized trading of life insurance policies.

  • Theft: This occurs when assets are taken without the victim's knowledge, consent, or authorization. It often includes taking personal property like cash, medications, or valuables belonging to the elderly or vulnerable adult.
